Alernative Dispute Resolution (ADR)

  • What it is:
    • ADR, as the name implies, is an alternative to litigating a dispute in a court of law. It is a flexible, less expensive and potentially less acrimonious method of resolving disputes.
    • Mediation/facilitation is a process by which disputants come together and through the assistance of a third party, reach their own solutions to their issues. Parties that are successful in this process tend to voluntarily live up to the terms of their agreements while preserving their relationship with one another. HemmingLaw strongly endorses this process and has seen very positive outcomes when clients utilize it.
    • Arbitration is a binding form of alternative dispute resolution. When parties cannot voluntarily resolve their dispute with the efforts of a third party, an individual acting as an arbitrator serves as the decision-maker. The decision is final and binding.
    • ADR as a flexible process does save clients time, money and stress. It brings finality to disputes, avoiding the long and costly appellate process that many times can follow a court trial.
  • What we do:
    • Joe Hemming has extensive training through the American Arbitration Association, the Community Dispute Resolution Program and the Oakland County Circuit Court to serve as a mediator, facilitator or arbitrator.
    • Hemming has mediated cases involving individual disputes and business disputes involving all sizes of businesses from small to large corporations and municipalities. As an arbitrator, Hemming has served as a single arbitrator as well as chair for three-person arbitration panels. In addition, he has served as discovery master in complex commercial matters.
